13 Ιουλ 2020 · California Penal Code 1170.95 is a response to a change in the felony murder law in California. It empowers anyone with a felony murder conviction to reassess their case and potentially revise their sentence.
California Penal Code § 207 PC defines the crime of kidnapping as moving another person a substantial distance, without the person’s consent, by means of force or fear. Simple kidnapping is a felony punishable by up to 8 years in state prison.
Essentially, under PC 1170.95, when a defendant is charged with a murder, even though he or she did not actually kill a person, then he or she might be able to have that murder conviction vacated if the murder by another person was not the natural and probable consequences of the defendant’s conduct.
To request resentencing under Penal Code 1170.95 PC, you have to submit a petition with the court stating why you should get a new sentence under Senate Bill 1437. If the court determines you would not have been convicted under the new law, they will vacate your murder conviction.
