UI fraud is a serious offense that carries some serious penalties. You will be required to repay any UI benefit payments you have received, along with interest and other mandatory penalties. You may NOT be able to collect additional UI benefits until the UI debt is repaid.
Will DWD assess a penalty if I do not report work and earnings while I am receiving unemployment benefits? For the first instance of fraud, a twenty-five (25%) penalty is assessed on the amount of the established overpayment.
22 Μαρ 2021 · Other penalties under state unemployment insurance laws generally include criminal prosecution with fines and/or incarceration; required repayment of fraudulently collected benefits; forfeiting future income tax refunds; and/or permanent loss of eligibility for unemployment compensation.
4 Μαρ 2021 · Indiana law allows DWD to collect that money back in a variety of ways, including intercepting state and federal tax refunds or lottery winnings. However that can be prevented if someone has appealed the overpayment or applied for it to be waived.
DWD is authorized to intercept state income tax refunds, lottery winnings, and federal income tax refunds to offset unemployment compensation debts, in addition to instituting wage garnishment proceedings and civil collection actions to recoup the debts.
