One tool that agencies historically have had at their disposal in these circumstances is the clause at Federal Acquisition Regulation (FAR) 52.217-8, Op-tion to Extend Services. Included in virtually all service contracts, the clause allows the government to require.
(1) A FAR provision or clause that otherwise is not authorized to be incorporated by reference (see sub part 52.3); or (2) A provision or clause prescribed for use in an agency acquisition regulation.
Of the 500+ FAR, DFARS, Agency FAR supplement, and local clauses, over ½ of them authorize changes to a contract given certain triggers. When one of these clauses covers the reason for the change, the clause is the authority for the change.
52.217-8 Option To Extend Services. As prescribed in 17.208 (f), insert a clause substantially the same as the following: Option To Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract.
