The Militia Act of 1862(12 Stat. 597, enacted July 17, 1862) was an Act of the 37th United States Congress, during the American Civil War, that authorized a militia draft within a state when the state could not meet its quota with volunteers.

The Militia act of July 1862 authorized the President to employ black people on behalf of the Union war effort as laborers and soldiers.
But supporters of the militia argued that a standing army could not possibly traverse the vast expanses of territory to adequately defend the new nation from foreign enemies. Instead, they chose to rely on the citizens themselves to protect and defend their country.
