The amount of termination pay awarded is the amount of income which the employee would have earned from his employer during the period of required “reasonable notice”.

Employees who are covered by the ESA, and who have at least five years' employment with their employer, are entitled to severance pay when their employment is severed, if: The employer has an annual payroll of at least $2.5 million, OR.
Employees and dependent contractors have an automatic entitlement to severance pay if their employers terminate their employment, in addition to any obligatory individual or collective notice of termination.
