Permits issued by the Service's Ecological Services Program are of three basic types: Incidental take permits may be sought when a non-federal entity believes their otherwise lawful activities may result in take of endangered or threatened animal species.

The Pennsylvania Fish and Boat Commission (PFBC) is responsible for protecting fish, reptiles, amphibians and aquatic invertebrates. In Pennsylvania, 29 fish, five reptile, five amphibian, and ten freshwater mussel species are currently listed as state endangered.
A threatened species is likely to become endangered in the foreseeable future. For endangered species, permits may be issued for scientific research, enhancement of propagation or survival, and taking that is incidental to an otherwise lawful activity.

Endangered Species - Permitting Process - Pennsylvania (a) Issuance.--The commission may issue permits for the importation, exportation, sale, exchange, taking or possession of any birds or animals classified as endangered or threatened, living or dead, or any parts thereof, including eggs.
