All HOA governing documents are public records in Texas. The records must be filed in the county where the property is located.
Senate Bill 1588 adds Section 209.017 of the Texas Property Code, which authorizes property owners to sue a property owners association that administers a subdivision development in justice court for violations of Chapter 209 of the Texas Property Code. This provision takes effect on September 1, 2021.

21 Αυγ 2024 · Texas law requires a property owners' association composed of more than 14 lots to implement a records retention policy. A records retention policy identifies important records of the association and states how long they must be kept. Section 209.005(m) of the Texas Property Code establishes mandatory retention times for some of these records:
