30 Αυγ 2023 · CHICAGO (AP) — A Texas judge ruled Wednesday that a new law eroding the power of the state’s Democratic-led cities to impose local regulations on everything from tenant evictions to employee sick leave is unconstitutional and cannot take effect.
House Resolution 17735, known as the Gun Control Act, was signed into law by President Lyndon B. Johnson on October 22, 1968 [11] banning mail order sales of rifles and shotguns and prohibiting most felons, drug users, and people found mentally incompetent from buying guns.
The plaintiffs alleged that the regulations, arising out of the Omnibus Crime Control and Safe Streets Act of 1968, were “unconstitutional because they infringe on the right of 18-to-20-year-old adults to keep and bear arms under the Second Amendment.”
At least eight state bills filed between 1989 and 2014 would have banned the rifle as an assault weapon and prohibited selling or possessing large-capacity magazines with more than 20 rounds.
The Gun Control Act of 1968 (GCA), 18 U. S. C. § 921 et seq., establishes a detailed federal scheme governing the distribution of firearms. It prohibits firearms dealers from transferring handguns to any person under 21, not resident in the dealer's State, or prohibited by state or local law from purchasing or possessing firearms, § 922(b).
2 Μαρ 2023 · In June 2021, the Biden administration announced it would change how it enforces the Gun Control Act of 1968. This enforcement policy is the latest of the administration’s many attempts to twist the meaning of old statutes to impose its preferred regulatory agenda.
The act prohibited the interstate shipment of pistols and revolvers to individuals, but it specifically exempted rifles and shotguns from any regulations. With the assassination of Robert F. Kennedy on June 5, 1968, the groundswell of support for tough gun control laws reached unprecedented levels.
