A Congressional Research article provides insight into the meaning of insurrection in the context of US federal law. The U.S. Constitution does not define insurrection or rebellion. Article 1, Section 8, clause 15, of the U.S. Constitution does empower Congress to call forth the militia “to suppress Insurrection.”
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.
Any act of rebellion or insurrection against the U.S. government constitutes a serious federal crime punishable by serious jail time and fines. This crime is embodied under Title 18 U.S. Code 2383. Simply put, this law makes it illegal to incite, assist with, or participate in a rebellion or insurrection against United States laws and authority.
