When the new and revised Rules of Professional Conduct become effective on November 1, 2018, California will finally join the other forty-nine states which have already adopted some version of American Bar Association [ABA] Model Rule 4.1 “Truthfulness in Statements to Others.”.
ABA Model Rule 1.11’s title refers to “Former and Current Government Officers and Employees” (plural, separated by the word “and”), but the next ABA Model Rule 1.12’s title refers to “Judge, Arbitrator, Mediator or Other Third-Party Neutral” (singular, separated by the word “or”).
