California passed Assembly Bill 2188 (AB 2188) on 8/30/22, bringing some important changes regarding how employers can test employees or job applicants for marijuana use and how they treat positive test results.

Under California law, adults 21 or older can use, carry, and grow cannabis (marijuana, weed, pot). Buying cannabis (without a current physician’s recommendation or a county-issued medical marijuana identification card) will become legal for adults 21 or older January 1, 2018.
To test cannabis legally in California, a laboratory must be licensed by the California Department of Cannabis Control. Testing laboratory licensees in the state are authorized to test both medical and recreational marijuana products.
