16 Νοε 2023 · In non-SBRA cases, chapter 11 trustees are appointed on a case-by-case basis upon motion of a party in interest or the United States Trustee and with approval of the court either for cause or in the best interest of creditors, equity security holders, or other interests of the estate.
Appointment of a Chapter 11 Trustee. When a motion has been filed, and following notice and a hearing, the Bankruptcy Court may order a Chapter 11 trustee to be appointed for cause if it finds fraud, dishonesty, incompetence, or gross mismanagement.
Private Trustee Appointments. The USTP appoints and supervises private trustees who administer bankruptcy estates under chapters 7, 12, and 13 of the Bankruptcy Code.
