15 Ιαν 2019 · California Civil Code section 1542 states that a general release of all claims will not apply to claims that are unknown to the claimant, if the claimant would not have signed had he or she been aware of the unknown claims. However, that provision may be waived.
Merely reciting that Civil Code section 1542 is waived, or that the parties intend to waive unknown claims, is not sufficient. There must be independent evidence that the releasing party intended to release unknown claims.
