After observing a suspicious vehicle, an officer made a stop for a traffic violation resulting in the arrest of the suspect for weapons and drug charges. A motion to suppress evidence was granted by the County Court at Law in Ellis County based upon a finding that there was no reasonable suspicion to support the original traffic stop.
Merely reciting that Civil Code section 1542 is waived, or that the parties intend to waive unknown claims, is not sufficient. There must be independent evidence that the releasing party intended to release unknown claims.
POLICY. Agencies should develop a policy statement to briefly and concisely explain to agency personnel and the public the agency’s policy on vehicular pursuits. Sample: Vehicular pursuits present a danger to the public, oficers, and suspects involved.
