A general release is a document in which one or more parties release one another from claims, lawsuits and threats of lawsuits. A general release can be one-sided and release only one party. Alternatively, it can be mutual and release two or more parties.

A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party. Merely reciting that Civil Code section 1542 is waived, or that the parties intend to waive unknown claims, is not sufficient. There must be independent evidence that the releasing party intended to release unknown claims.
