This paper briefly discusses, in simple, non-technical language, the basic principles of evidence with which fraud and corruption investigators should be familiar, followed by their application to the proof of Corrupt and Fraudulent Practices.
A fraud victim’s right to recover money or property, or their equivalent in monetary damages, from another person—and the remedies by which they can recover them—requires that the person obtained that money or property unlawfully (i.e., by conduct that violates one or more laws).

It is well settled that in appropriate cases the federal courts may grant relief from prior judgments obtained by fraud.26 When the judgment being attacked was rendered by a state court rather than another federal court, relief may be had only in an independent action which attacks the prior decree.
