Substance abuse can be cited as a ground for a fault-based ground for divorce in Louisiana. A spouse must be able to prove that the substance abuse took place or is currently taking place and provide suitable evidence to the courts.
Fault: Because Louisiana is a fault divorce state, you can include grounds for divorce in your divorce petition. If you are at fault with issues such as addiction, adultery, or domestic violence, a court may determine you will not receive spousal support.

La. C.C. art. 111 provides that a party must be free from fault “prior to the filing of a proceeding to terminate the marriage,” as opposed to prior to the rendition of the divorce judgment.
In a proceeding for divorce or thereafter, the court may award interim periodic support to a party or may award final periodic support to a party who is in need of support and who is free from fault prior to the filing of a proceeding to terminate the marriage in accordance with the following Articles.
Courts would prevent spouses from collecting any final alimony if they were found to be at fault for the divorce. So spouses who commit adultery that leads to the marriage breakdown are not eligible for support in Louisiana. How long do I have to make a claim for spousal support?
