Print Email Share. Filing a Formal Complaint. If you decide to file a discrimination complaint, you must do so within 15 days from the day you received notice from your EEO Counselor about how to file a complaint. This notice is sent to you after your final interview with the EEO Counselor.
If you are a federal employee, former federal employee, or job applicant for a federal job, and you believe that a federal agency has discriminated against you with regard to employment, you have a right to file a complaint.

Federal EEO Complaint Processing Procedures. Contact EEO Counselor. Aggrieved persons who believe they have been discriminated against must contact an agency EEO counselor prior to filing a formal complaint. The person must initiate counselor contact within 45 days of the matter alleged to be discriminatory. 29 C.F.R. Section 1614.105 (a) (1).
