Employees must be given notice and an opportunity to change plans or benefits if plans or benefits change while they are on FMLA leave. To maintain insurance coverage while on FMLA leave, an employee will need to continue to make any normal contributions to the cost of health insurance premiums.
Family and Medical Leave Act (FMLA) The FMLA applies to any private-sector employer who has 50 or more employees within a 75-mile radius. The FMLA requires these employers provide up to 12 weeks of unpaid, job-protected leave for their employees.
Once an employer meets the requirement for FMLA coverage, the employer is a covered employer and will remain covered as long as it employs 50 or more employees in 20 or more workweeks in either the current calendar year or in the previous calendar year.
