The means test is a two-part evaluation that does not analyze a debtor’s income in isolation but considers income in relation to one’s secured and unsecured debt obligations. The first part of the evaluation involves comparing the income of the debtor to the median income in Florida.
12 Ιουλ 2023 · The Chapter 7 means test determines whether allowing someone to discharge their debts would be an abuse of the bankruptcy system. If your gross income based on the six months before filing bankruptcy is below the median income for your state, you pass the means test.
If you would like to file a Chapter 7 bankruptcy you must pass the Florida means test. The test only applies to higher income filers which means that if your income is below the Florida median for your household size you are exempt from the test and may file a Chapter 7.
