30 Σεπ 2016 · The grand jury votes an indictment when at least 12 grand jurors think there is enough evidence against you. The grand jury can find that there isn’t enough evidence for the felony, but that there is enough evidence for a misdemeanor.
This handbook is for citizens summoned to serve as grand jurors in New York State. It is designed to answer commonly asked questions about grand jury service. Whether or not you actually sit on a grand jury, this handbook has information that everyone should know about grand juries and grand jury service.

The function of a grand jury is to hear evidence concerning alleged crimes. The grand jury does not have to determine issues of guilt or innocence. The grand jury must determine if there is enough evidence to indict a person. Decisions do not have to be unanimous for an indictment.
