Run the server for the first time by typing java -jar minecraft_server.jar --nogui (replacing the jar name (minecraft_server.jar in this case) by whatever you named the jar file to be). A file called eula.txt will be generated after you run the server for the first time.
First make sure you can use java from the command line. On Linux and macOS this should already be set up but on Windows you might have to tinker with the PATH environment variable. Download minecraft_server.1.21.3.jar and run it with the following command: java -Xmx1024M -Xms1024M -jar. minecraft_server.1.21.3.jar. nogui.
