12 Ιουλ 2019 · The recently passed “Housing Stability and Tenant Protection Act,” has drastically overhauled the fundamentals of landlord-tenant law and practice in the State of New York. While we’re still digesting the impact of these changes, here’s a quick overview of just some of the key modifications:
Under New York law, if a written or oral rental agreement exists, or if payment is accepted as rent, landlords and tenants have automatic rights and responsibilities under NY Real Property Law § 220-238A, such as the right to timely rent payments and a livable dwelling.
New York City residential hotel owners and tenants are governed by the rent stabilization law, enforced by the DHCR. A lease is a contract between a landlord and a tenant that contains the terms and conditions of the rental. It cannot be changed while it is in effect unless both parties agree.
A landlord must provide written notice to tenants of its intention to increase rent by more than 5% or to not renew a tenant’s lease. If the landlord fails to do so, the tenancy continues until notice period expires, regardless of any other lease provision.
