Fourth Department Decisions. Generally, decision-orders are released two weeks after the conclusion of the term, at 3:00 p.m. An appeal or proceeding not decided on the decision date is still pending before the Court -- check future decision-order releases.
The Appellate Division has the power to review issues of both law and fact in civil and criminal matters. The Appellate Division hears appeals from the State's trial courts, including Supreme Court, County Court, Family Court, Surrogate's Court and the Court of Claims.
The Appellate Division primarily hears appeals from the state's superior courts (Supreme Court, Surrogate's Court, Family Court, Court of Claims, the county courts) in civil cases, the Supreme Court in criminal cases, and, in the Third and Fourth Judicial Departments, from the county courts in felony criminal cases. The Supreme Court of the State of New York, Appellate Division, Fourth Judicial Department, or simply the Fourth Department, is one of the four geographical components of the New York Supreme Court, Appellate Division, the intermediate appellate court of the State of New York.
16 Οκτ 2024 · The Court convenes at 10:00 a.m. and immediately calls the first case. The Court's day calendar generally contains between 20 to 30 appeals.
