The Appellate Division has the power to review issues of both law and fact in civil and criminal matters. The Appellate Division hears appeals from the State's trial courts, including Supreme Court, County Court, Family Court, Surrogate's Court and the Court of Claims.
It primarily hears appeals from the superior courts in civil cases, the Supreme Court in criminal cases, and the County Court in felony criminal cases in the Third and Fourth Judicial Departments. [3]
The Appellate Division primarily hears appeals from the state's superior courts (Supreme Court, Surrogate's Court, Family Court, Court of Claims, the county courts) in civil cases, the Supreme Court in criminal cases, and, in the Third and Fourth Judicial Departments, from the county courts in felony criminal cases. [5]
The New York Court of Appeals is the highest court in the Unified Court System of the State of New York. [1] It consists of seven judges: the chief judge and six associate judges, who are appointed by the governor and confirmed by the state senate to 14-year terms.
