Overtime Pay, Salary and Comp Time. An employer must pay its employees at least the minimum wage for all hours worked, and time and one-half overtime pay based on an employee's regular rate of pay for all hours worked in excess of 40 in a workweek unless the employee is exempt for some reason.
The overtime rule could require some employees whose annual base salary is below the new threshold to transition to hourly (non-exempt status) while other employees may see a pay adjustment to maintain their exempt status.
18 Ιαν 2024 · North Carolina, like many other states, follows the federal Fair Labor Standards Act (FLSA), which states that eligible employees who work above 40 hours a workweek receive overtime pay of at least one and a half times their regular pay rate for the hours worked beyond 40.
North Carolina labor laws require an employer to pay overtime to employees, unless otherwise exempt, at the rate of on and one-half (1½) times the employee’s regular rate of pay for all hours worked in excess of 40 hours in a workweek.
Overtime compensatory time shall be taken within twelve months from the date the work is performed. If not taken within 365 days, the time shall be paid out in the next paycheck. • If an employee separates before taking overtime compensatory time, it shall be paid in a lump sum along with unused vacation. •
Overtime Pay Coefficient Table. This table may be used for computing overtime on piecework, bonuses, commissions or fixed salaries for varying hours. Refer to Part 778 of Title 29 of the CFR for guidance regarding when the coefficient method is applicable.
The Fair Labor Standards Act (FLSA) automatically qualifies certain types of workers who meet overtime pay requirements to receive overtime for all hours worked over 40 in a single week (or daily overtime limits set by North Carolina overtime laws).
