Overtime Pay, Salary and Comp Time. An employer must pay its employees at least the minimum wage for all hours worked, and time and one-half overtime pay based on an employee's regular rate of pay for all hours worked in excess of 40 in a workweek unless the employee is exempt for some reason.
Breaks. Most California workers must receive the following breaks: An uninterrupted 30-minute unpaid meal break when working more than five hours in a day. An additional 30-minute unpaid meal break when working more than 12 hours in a day. A paid 10-minute rest period for every four hours worked.
Generally, employees have no legal basis on which to refuse working overtime in California. There are, however, exceptions under certain specific Wage Orders, or a company policy or union contract addressing the subject.
