28 Φεβ 2020 · A service animal must be under the control of its handler. Under the ADA, service animals must be harnessed, leashed, or tethered, unless the individual’s disability prevents using these devices or these devices interfere with the service animal’s safe, effective performance of tasks.
Accordingly, entities that have a "no pets" policy generally must modify the policy to allow service animals into their facilities. This publication provides guidance on the ADA's service animal provisions and should be read in conjunction with the publication ADA Revised Requirements: Service Animals.
Residents of Virginia who need a service dog are legally protected under federal law and state-specific statutes. The Americans with Disabilities Act (ADA) and Virginia Code §51.5-44 safeguard the rights of service dog owners in the Old Dominion.
