28 Φεβ 2020 · Under the ADA, State and local governments, businesses, and nonprofit organizations that serve the public generally must allow service animals to accompany people with disabilities in all areas of the facility where the public is allowed to go.
Under the Fair Housing Act, there may be different rules that apply when a resident or applicant with a disability uses a service animal or other animal to assist with their disability. The U.S. Department of Housing and Urban Development is responsible for administering the Fair Housing Act.
28 Φεβ 2020 · Under the Fair Housing Act, housing providers are obligated to permit, as a reasonable accommodation, the use of animals that work, provide assistance, or perform tasks that benefit persons with disabilities, or provide emotional support to alleviate a symptom or effect of a disability.
A service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability.
ADA regulations by the Department of Justice (DOJ) and Department of Transportation (DOT) originally defined service animals as “any guide dog, signal dog, or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability.”
29 Μαρ 2024 · Dogs that are considered service animals are treated as working animals, not pets, under federal law. Emotional support animals, while not protected under the ADA, do have protections under some other disability-related laws such as the Fair Housing Act and the Air Carrier Access Act.
According to Title II and III of the ADA, a service animal is any dog that is individually trained to do work or perform tasks for an individual with a disability. Service animals can benefit individuals with a wide range of disabilities, including a physical, sensory, psychiatric, intellectual, or other mental disability.
