27 Δεκ 2018 · Herbert Eugene Anderson, Jr., was convicted by a jury of three family violence charges—one charge of simple battery (OCGA § 16-5-23 (f) ) and two charges of trespass (OCGA §§ 16-7-21 (b), 19-13-1). He appeals, contending that there was insufficient evidence to convict on any of the charges.

Since Gillespie was charged under the family violence provision of OCGA § 16-5-23 (f), the misdemeanor battery offense was “of a high and aggravated nature.”

The jury returned a verdict of guilty on all charges, and Williams subsequently filed a motion for new trial. Following a hearing, the trial court denied the motion, as amended, and this appeal followed.
(i) Any person who commits the offense of simple battery against an employee of a public school system of this state while such employee is engaged in official duties or on school property shall, upon conviction of such offense, be punished for a misdemeanor of a high and aggravated nature.
