In an individual chapter 7, 12, or 13 case closed without entry of discharge for failure to meet the requirements of Bankruptcy Rule 1007(b)(7) or Local Rule 4004-3(A)(3) or (4), the clerk shall serve notice that the case was closed without entry of a discharge.
15 Οκτ 2021 · When a Chapter 13 case is dismissed, it is not unusual for the debtor to start the process again by filing a new Chapter 13 case. This often happens when the debtor has an interruption in income and cannot get caught up on the required payments.
A case may be closed by the clerk’s office without a discharge if certain required documents are not timely filed. It is not necessary to file a motion to reopen the case in order to file the missing documents and receive a discharge.
