What Is Small Claims Court? Small claims court is a special court where disputes are resolved quickly and inexpensively. In small claims court, the rules are simplified and the hearing is informal. Attorneys are generally not allowed. The person who files the claim is called the plaintiff.
Limited civil cases are cases for $35,000 or less. For lawsuits for $12,500 or less, the person suing (plaintiff) may be able to file in small claims court instead. Business entities, like a corporation, can sue for up to $6,250 in small claims court.
Cases are not always called in the order listed on the court calendar, so be sure to stay in the courtroom. When the judge is ready to hear your case, the clerk or judge will call the names of all plaintiffs and defendants in the case.
The small claims court has jurisdiction of claims arising out of nonpayment of rent that occurred between March 1, 2020, and September 30, 2021, related to the COVID-19 pandemic.
