Probate Forms. Where can I find court approved forms? The Virginia Judicial System has a number of forms for each court available on the court's form page.
PROBATE INFORMATION FORM Court File No.: ................................................ COMMONWEALTH OF VIRGINIA (For appointment of executor, administrator, curator, and/or probate of a will without qualification.)
GENERAL: This form provides the Clerk of Court with information necessary to probate wills, and to appoint persons to carry out the terms of wills or to settle the estates of persons who have died without wills.
I. WHAT IS PROBATE? Probate is the official proving and recording of the will as the authentic and valid last will and testament of the deceased. II. WHERE SHOULD THE WILL BE PROBATED? Virginia has no separate probate court. The will should be probated in the circuit court in the county or city where the decedent resided at the time of death.
The Virginia Supreme Court website contains many of the forms that are commonly used during the probate process. Below are links to the most commonly requested forms for a decedent’s estate (testate and intestate), trust estate, incapacitated adult’s estate and minor’s estate.
