Employers with ten or more full time employees at any one location or annual gross sales over $100,000 that are not covered by the FLSA can take a tip credit of no more than 50 percent ($3.62) of the applicable minimum wage of $7.25. The State law excludes from coverage any employment that is subject to the federal Fair Labor Standards Act.
Texas allows employers to take a tip credit. Employers must pay tipped employees at least $2.13 an hour. If an employee doesn't earn enough in tips to bring his or her total compensation up to at least the full state minimum wage rate an hour, the employer must make up the difference.
8 Ιαν 2021 · Generally speaking the FLSA mandates that employers must pay their employees a minimum of $7.25 an hour for the work they perform. Among the various exemptions and loopholes that are found within the FLSA is an employer’s ability to claim a “tip credit” on certain tipped employees.
The Fair Labor Standards Act (FLSA) and Texas Payday Law both recognize tips as wages to the tipped employee. They are subject to minimum wage requirements, overtime pay and several unique wage rules.
